The states sued the social-media giant for endangering children with addictive practices that undermine their mental health. On Wednesday, Meta settled <a href=\"https:\/\/www.nytimes.com\/2026\/08\/26\/technology\/meta-settlement-social-media-addiction-lawsuit.html\">for $17.1 billion<\/a>.<\/p>\n<p>The settlement is not just about the money. These kinds of settlements never are. As part of the deal, Meta agreed to make massive changes to how it tries to trap kids on its platforms, which also include Instagram. Some of these settlement-imposed restrictions are things you could never achieve through congressional regulation. For instance, Meta agreed to set time limits on how long teens can be logged in to Facebook and Instagram. If you tried to impose that through legislation, somebody would sue the government, and the pro-business, Republican-controlled Supreme Court would likely overturn it. But if Meta is doing it \u201cvoluntarily\u201d (if \u201cvoluntarily\u201d means at the point of a tort gun), there\u2019s nothing John Roberts can do.<\/p>\n<p>So which tech-boy mega-business is going to get the tort treatment next? Every day, the rising <a href=\"https:\/\/bookshop.org\/p\/books\/the-nerd-reich-silicon-valley-fascism-and-the-war-on-democracy-gil-dur-n\/a6f6f0dce1150339\">Nerd Reich<\/a> tramples more and more of our jobs, our democracy, our freaking mental health. While the government aids and enables, tort law is beginning to look like our best regulatory hope. Our regulators of last resort.<\/p>\n<p>I know that sounds counterintuitive to a lot of people. We\u2019ve been trained to think that regulation requires congressional legislation followed by enforcement by the executive branch. We\u2019ve been trained to think that the threat of criminal penalties, including jail time, restrains the worst instincts of the oligarch class.<\/p>\n<p>It\u2019s great when those levers work, but at the end of the day, the only thing the billionaires really care about is money. Tort lawyers <em>take their money<\/em>. Most big business interests can buy their way out of jail (see, for instance, the precisely zero people jailed for their roles in the 2008 financial collapse). Most congressional legislation merely changes the parameters of how these people make their money. Most antitrust laws\u2026 are never enforced. But tort lawyers can reach into these companies\u2014through lawsuits filed by private individuals or state and government institutions themselves\u2014and take money away from these people. It worked against the tobacco industry. It\u2019s pretty much the only thing that has ever worked against the fossil fuel industry. It worked against the Sackler family. It <em>was working<\/em> against the gun industry, until ammosexuals passed a whole law to stop it from working. (I have a whole chapter on this in my book, <a href=\"https:\/\/www.amazon.com\/dp\/162097858X?lv=shuf&amp;channelId=500&amp;plpRedirect=mhFallback\"><em>Bad Law<\/em><\/a>).<\/p>\n<p>And I promise you, it\u2019s the only thing that is going to work against Big Tech.<\/p>\n<p><strong>The Bad and the Ugly<\/strong><\/p>\n<ul class=\"wp-block-list\">\n<li>I have enjoyed not thinking about Maine politics for a couple of weeks, but I was shocked out of my complacency by the Republican gubernatorial candidate, Bobby Charles. He said he\u2019s going to ask the Trump administration to <a href=\"https:\/\/www.democracydocket.com\/news-alerts\/maine-gop-governor-nominee-plans-to-ask-trump-admin-to-send-ice-to-the-polls\/\">send ICE agents to the polls<\/a> for the election. \u201cHere\u2019s my secret,\u201d he told a bunch of Maine Young Republicans, according to audio from the event. \u201cI have a friend named Tom Homan\u2026. I\u2019m going to make an appeal [to Tom] for ICE and Marshals to be at our voting booths.\u201d On the positive side, every Stephen King novel I\u2019ve read tells me that ICE cannot possibly be scarier than any of the other things that lurk in Maine.<\/li>\n<li>A Republican judge <a href=\"https:\/\/www.democracydocket.com\/news-alerts\/judge-blocks-maryland-democrats-redistricting-plans-setting-up-state-supreme-court-appeal\/\">blocked<\/a> a proposed ballot amendment that would have let Maryland voters decide if they want to redistrict their state to give Democrats more of an advantage. This is in keeping with the apparent rule that only Republicans can try to win elections.<\/li>\n<li>Last week, I mentioned that Texas refused to extradite an ICE agent accused of a crime to Minnesota to stand trial. Now, <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/ice-officer-charged-minneapolis-shooting-released-texas-immediate-extr-rcna594704\">Texas has released the man<\/a>. It\u2019s feared he might flee to\u2026 Mexico.<\/li>\n<li>A federal judge <a href=\"https:\/\/www.courthousenews.com\/judge-denies-karmelo-anthonys-motion-for-a-new-trial\/\">denied<\/a> Karmelo Anthony\u2019s appeal for a new trial.<\/li>\n<li>Republican Senator Josh Hawley has started <a href=\"https:\/\/www.courthousenews.com\/hawley-kicks-off-senate-probe-into-flock-cameras\/\">a Senate probe<\/a> into the use of Flock cameras. Every now and again, Hawley does something right, because he appears to be one of the only senators who is as suspicious of emerging technology as he should be and seems to generally understand how it works. But, since I\u2019m sure as hell not going to close this section by saying nice things about Josh Hawley, here is a <a href=\"https:\/\/www.youtube.com\/watch?v=7xOURK7-UMs\">video of an unknown hero<\/a> who showed up to a city council meeting in San Diego in a Darth Vader costume to make the case <em>for<\/em> Flock cameras as an essential technology for the Evil Empire.<\/li>\n<\/ul>\n<p><strong>Inspired Takes<\/strong><\/p>\n<ul class=\"wp-block-list\">\n<li>I did not know that we are experiencing a \u201cmunitions shortage,\u201d but apparently the American military is low on bullets? I\u2026 can\u2019t think of anything better. In <em>The Nation<\/em>, William Hartung <a href=\"https:\/\/www.thenation.com\/article\/politics\/pentagon-munitions-shortage-foreign-policy\/\">begs<\/a> Democrats not to try to solve the \u201cproblem\u201d by giving Pete Hegseth more money.<\/li>\n<li>In <em>The Nation<\/em>, Bryce Covert explains that the Trump administration wants to change the Head Start program to <a href=\"https:\/\/www.thenation.com\/article\/society\/head-start-homeless-children\/\">de-prioritize enrolling homeless children<\/a>. I\u2019m a Truth and Reconciliation guy, not a Committee of Public Safety guy.<\/p>\n<p>But I have a number of problems with the arrest of this man, who remains unnamed.<\/p>\n<p>First of all, he did not go full Robespierre on the Supreme Court. It\u2019s hard for me to look at a guillotine as a \u201ctrue threat,\u201d which is the legal standard here. That means I don\u2019t think he intended to cause imminent harm to the Supreme Court justices. It seems to me that he was making a political statement, not a violent threat.<\/p>\n<p>It would seem the authorities agree with me on this point, because the man has not been charged with attempted murder, criminal menace, intimidation, or harassment. Instead, they\u2019ve charged him with transporting a deadly weapon\u2014which is where we do not agree. This guy could have carried a fucking assault rifle while driving a Humvee, and nobody would have charged him with anything. If he had been arrested with an assault weapon, he could have appealed to his Second Amendment \u201crights,\u201d and the Supreme Court\u2014the same one he drove all the way from California to visit\u2014likely would have ordered him released. I cannot countenance living in a world where driving around with a rickety, premodern slicing device is an illegal act, but driving around with a weapon of modern mass warfare is a protected right.<\/p>\n<p>Let me put it like this: I\u2019m more comfortable with a First Amendment right to erect a guillotine outside the Supreme Court than I am with a Second Amendment right to stand erect with an AR-15 outside a Walmart. I am 100 percent sure we\u2019d be a safer, more civilized country under my rule than the one promoted by the Supreme Court.<\/p>\n<p>And this is where I remind you that the guys who erected a gallows outside of Congress on January 6 while people literally attacked the Capitol threatening to cause harm to government officials have never even been <em>found<\/em>, much less arrested and charged with a crime.<\/p>\n<p>It\u2019s the hypocrisy that bothers me.<\/p>\n<p><strong>What I Wrote<\/strong><\/p>\n<p><a href=\"https:\/\/www.thenation.com\/article\/politics\/supreme-court-mail-in-voting\/\">I explained<\/a> the Supreme Court\u2019s shadow docket decision allowing Donald Trump to proceed with his plans to restrict mail-in voting ahead of the midterm elections. The court said the case is not \u201cripe\u201d for review, meaning that, because Trump\u2019s plans have not yet been carried out, the states suing to stop him have not suffered any harm.<\/p>\n<p>Since the ruling, the US Post Office has started to implement Trump\u2019s rules. So a collection of states have <a href=\"https:\/\/www.democracydocket.com\/news-alerts\/democratic-states-launch-new-legal-battle-over-trumps-mail-voting-order\/\">sued again<\/a>. Hopefully, the court will not be able to hide behind procedure this time and will have to confront Trump\u2019s plans to rig the election.<\/p>\n<p><strong>In News Unrelated to the Current Chaos<\/strong><\/p>\n<p>This has been a tough week in celebrity deaths. We lost music icon, feminist trailblazer, and vaccine benefactor Dolly Parton (whose <a href=\"https:\/\/www.thenation.com\/article\/economy\/dolly-parton-obituary-unions-9-to-5\/\">proud union history<\/a> John Nichols recounted in <em>The Nation<\/em>). And we lost the comedic genius Tim Curry.<\/p>\n<p>They say bad things come in threes\u2014and for me, the third tragedy of the week was <a href=\"https:\/\/www.hollywoodreporter.com\/movies\/movie-news\/peter-cullen-optimus-prime-transformers-eeyore-1236683075\/\">the death<\/a> of the voice actor Peter Cullen. You might not immediately recognize his name, but if you are of a certain age, you have certainly heard his work. Cullen was the voice of Optimus Prime in both the original <em>Transformers<\/em> cartoons and the animated feature, as well as the later Michael Bay movies, and the voice of Eeyore in the <em>Winnie-the-Pooh<\/em> cartoons. The actor was part of the soundtrack of many of our childhoods.<\/p>\n<p>Cullen became one of my heroes inadvertently because, when I was a kid, I was sure Cullen (or Optimus and Eeyore) was Black. In a world full of white voices playing white heroes, I was positive that Cullen was one of my people. I thought that his deep baritone came from a Black man. After all, Darth Vader was Black. It made sense to me that they wouldn\u2019t allow the depiction of a Black guy as the actual hero leader, so you could only get away with it if the Black guy looked like a robot. And it made <em>perfect sense<\/em> to me that the donkey who always knew how things could go wrong was a Black guy at heart. (At the time, I had no idea that the two characters were voiced by the same actor.)<\/p>\n<p>I didn\u2019t learn Cullen was white until I was in college and was gifted the magic of a Yahoo search engine.<\/p>\n<p>By then, it didn\u2019t matter. I had found other Black heroes and was old enough not to need representation in white media as much. Simply <em>thinking<\/em> Cullen was Black had served its childhood purpose.<\/p>\n<p>So rest in peace, Peter Cullen: a white man who sounded so cool he could have been Black.<\/p>\n<p class=\"has-text-align-center\">***<\/p>\n<p><em>If you enjoyed this installment of\u00a0<\/em>Elie v.
