{"id":3041,"date":"2026-08-23T04:23:42","date_gmt":"2026-08-23T04:23:42","guid":{"rendered":"https:\/\/valutednews.com\/?p=3041"},"modified":"2026-08-23T04:23:42","modified_gmt":"2026-08-23T04:23:42","slug":"the-eu-commissions-secret-plan-to-share-eu-citizens-most-sensitive-data-with-israel","status":"publish","type":"post","link":"https:\/\/valutednews.com\/?p=3041","title":{"rendered":"The EU Commission&#8217;s Secret Plan to Share EU Citizens&#8217; Most Sensitive Data With Israel"},"content":{"rendered":"<div style=\"text-align:center\"><\/div><p><\/p>\n<div>\n<p><strong>For three years the Von der Leyen Commission has been secretly negotiating to hand over its citizens\u2019 data to a state committing multiple genocides.\u00a0<\/strong><\/p>\n<p>Tel Aviv may have lost the hearts and minds of the vast majority of people in the so-called \u201ccollective West\u201d a long time ago, but it can still count on the support, however reluctant, of most of their governments.<\/p>\n<p>Since the\u00a0<a href=\"https:\/\/x.com\/s_m_marandi\/status\/2090352918872326318\" target=\"_blank\" rel=\"nofollow noopener\">ongoing genocide<\/a>\u00a0in Gaza began almost three years ago, only a tiny handful of nations have cut or downgraded their relations with Israel. Some of those countries (Colombia, Honduras, Chile and Bolivia) have since reversed course following a change of government.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/preview.redd.it\/countries-that-have-cut-or-downgraded-relations-with-israel-v0-1zy0fwfo77of1.jpeg?width=640&amp;crop=smart&amp;auto=webp&amp;s=1a0dd53f644c30ecc49a040f965d18942a0e6aa2\" alt=\"r\/MapPorn - Countries that have cut or downgraded relations with Israel\"\/><\/p>\n<p>Public support for Israel in Western Europe is now at its lowest point ever, <a href=\"https:\/\/www.theguardian.com\/world\/2025\/jun\/03\/public-support-for-israel-in-western-europe-lowest-ever-recorded-yougov\" target=\"_blank\" rel=\"nofollow\">according to<\/a> a recent YouGov poll. Fewer than a fifth of respondents in the six countries polled still hold a favourable view of the country.<\/p>\n<p>Earlier this year, over a million EU citizens signed a petition <a href=\"https:\/\/eci.ec.europa.eu\/055\/public\/#\/screen\/home\" target=\"_blank\" rel=\"nofollow noopener\">calling for the<\/a>\u00a0<a class=\"rm-stats-tracked\" href=\"https:\/\/eci.ec.europa.eu\/055\/public\/#\/screen\/home\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><u>suspension<\/u><\/a>\u00a0of the\u00a0<a class=\"rm-stats-tracked\" href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A02000A0621%2801%29-20130701\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><u>EU-Israel Association Agreement<\/u><\/a> via a European Citizens\u2019 Initiative. In April, the governments of Spain, Slovenia and Ireland proposed to suspend the association agreement. That was enough to force the EU Council to at least pretend to consider the idea before the governments of<span style=\"font-size: 1rem\"> Germany and Italy <a href=\"https:\/\/www.aljazeera.com\/news\/2026\/4\/21\/spain-slovenia-ireland-push-eu-to-debate-israel-pact-suspension\" target=\"_blank\" rel=\"nofollow\">poured cold water all over it<\/a>.<\/span><span style=\"font-size: 1rem\">\u00a0<\/span><\/p>\n<p>As a result, billions of dollars worth of trade, much of it military gear and tech, <a href=\"https:\/\/www.aljazeera.com\/news\/2026\/7\/2\/billions-flow-between-eu-institutions-and-israel-despite-gaza-genocide\" target=\"_blank\" rel=\"nofollow\">continues to flow<\/a> between the Jewish State and the EU, Israel\u2019s biggest trade partner, each month. Meanwhile, the lack of any real consequences for its ever-growing roster of war crimes in Gaza means that Israel has felt free to further expand its genocidal campaign.<\/p>\n<p>In Southern Lebanon an estimated 20% of the region\u2019s farmland and forests have been destroyed and 270,000 residents displaced, according to a recent FT report. As Shaiel Ben-Ephraim <a href=\"https:\/\/x.com\/academic_la\/status\/2087653920684552410?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E2087653920684552410%7Ctwgr%5E94985e26d78bf0d578a5e03b53800b57e0aadbaf%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fwww.nakedcapitalism.com%2F2026%2F08%2Flinks-8-15-2026.html\">notes<\/a>, \u201cthis is stated policy and an intentional plan to make an entire area uninhabitable and never allow the population to return.\u201d<\/p>\n<p>Israel is now doing much the same in the West Bank. According to an exclusive report by\u00a0<a href=\"https:\/\/euobserver.com\/230339\/exclusive-leaked-legal-advice-says-euisrael-police-data-deal-breached-international-law-yet-eu-commission-kept-europol-talks-going\/\" target=\"_blank\" rel=\"nofollow noopener\">EU Observer<\/a>\u00a0and\u00a0<a href=\"https:\/\/statewatch.org\/analyses\/2026\/eu-us-data-exchange-proposal-in-conflict-with-eu-laws\/\" target=\"_blank\" rel=\"nofollow noopener\">State Watch<\/a>, the EU\u2019s Von der Leyen Commission has been secretly negotiating a\u00a0deal that would\u00a0allow the wholesale transfer of sensitive personal data from EU systems to Israeli authorities.<\/p>\n<p>That data would apparently include the biometric information, genetic data, location tracking, political opinions, health information and trade union affiliations of EU citizens. The agreement would operate through Europol, the EU\u2019s policing agency, and the data would be available to Israel\u2019s National Police and internal security service, <em>Shin Bet<\/em>.<\/p>\n<p>The proposed agreement would represent a huge step up from a 2018 deal that explicitly ruled out personal data sharing and explicitly excluded the occupied Palestinian territories. This version includes both.<strong>\u00a0<\/strong><\/p>\n<p>The negotiations have continued until now, throughout Israel\u2019s genocide in Gaza. This is despite a warning from the EU Council\u2019s legal advisors in late 2022 \u2014 almost a year before that genocide began \u2014 that allowing data to be used in the occupied Palestinian territories risked legitimising Israel\u2019s occupation of Palestine and would be in breach of international law.<\/p>\n<p>Keep in mind that the EU has run a mission in the West Bank to support the Palestinian Authority with policing since 2005. If the data sharing agreement goes ahead, the data collected by EU police missions operating in the West Bank and the Gaza Strip city and Rafah could be fed into Israel\u2019s existing military surveillance systems.<\/p>\n<p>The really twisted part, as Deaglan O\u2019Mulrooney <a href=\"https:\/\/thespectaclemag.substack.com\/p\/the-eu-is-secretly-negotiating-to\" target=\"_blank\" rel=\"nofollow\">notes<\/a> in an article for Washington University\u2019s <em>The Spectacle Mag<\/em>, is that the EU\u2019s own legal service declared the agreement unlawful in 2022. The Commission, in time-honoured fashion, carried on regardless:<\/p>\n<blockquote>\n<p>The Council Legal Service concluded that the Commission had breached its negotiating mandate, violated EU treaty requirements, and failed to consult the relevant working group. The lawyers specifically objected to provisions that would allow data shared with Israel to be used in the occupied Palestinian territories, warning it would be the first time an international agreement between the EU and Israel would provide for its application to the territories occupied since 1967, and that it would violate the Palestinian people\u2019s right to self-determination and breach international law. The Commission read all of this, noted it, and continued negotiating anyway.<\/p>\n<p>The agreement was formally frozen in late 2022 following the legal objections. What Statewatch\u2019s investigation reveals is that it did not stay frozen. Commission officials held at least seven meetings with Israeli diplomats between January 2023 and January 2026, including one with Israel\u2019s then-foreign minister Eli Cohen in April 2023. When Statewatch asked the Commission about the current status of the negotiations, it refused to comment. When asked whether it had prepared a revised draft addressing the legal objections, it declined to answer. The Israeli embassy, foreign ministry, and police also declined to respond. Europol, for its part, described itself as a \u2018passive observer\u2019 in the negotiations while simultaneously hosting at least five Israeli delegations between August 2024 and March 2026, with meetings facilitated by Israel\u2019s liaison officer to Europol and culminating in a visit from the Israeli ambassador to the Netherlands to Europol\u2019s headquarters in The Hague in March of this year.<\/p>\n<\/blockquote>\n<p>\u201cThe data transferred via the agreement could be used as intelligence to support decisions to attack and kill Palestinians,\u201d legal expert Eitan Diamond <a href=\"https:\/\/novaramedia.com\/2026\/08\/04\/eu-moves-to-share-data-with-israel-that-could-be-used-to-kill-palestinians\/\" target=\"_blank\" rel=\"nofollow\">told<\/a> <em>Statewatch<\/em>. \u201cThe EU would run the risk of arbitrarily depriving people of their freedom and subjecting them to systematic ill-treatment under hellish conditions in detention.\u201d<\/p>\n<p>Conditions like these\u2026<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The use of trained rape dogs in Israeli prisons is so well-documented at this point that there is no valid reason to doubt it is happening. As O\u2019Mulrooney notes, all states and international organisations were instructed to avoid any action that could help maintain that unlawful presence:<\/p>\n<blockquote>\n<p>The proposed agreement would do precisely the opposite, enabling Israeli security forces to operate more effectively across the occupied territories using data provided by European institutions. The Commission has known this. It has continued negotiating regardless\u2026<\/p>\n<p><em>Douwe Korff<\/em>, a legal scholar at Yale University, described it as deeply concerning that the Commission appeared to be moving towards sharing sensitive data about people across the EU, including all their communications with aid workers, officials, and journalists in Israel and the occupied territories, with a state that has carried out targeted killings of children, aid workers, and journalists on an unprecedented scale and is credibly accused of genocide.<\/p>\n<\/blockquote>\n<p>In July 2026, 27 MEPs finally submitted written questions about the negotiations. Mounir Satouri, a French Green MEP, said \u201cwe are facing a double scandal\u201d because of the \u201cserious violations of international humanitarian law in Gaza\u201d and the \u201cutmost secrecy, shielded from parliament\u2019s scrutiny\u201d in which this deal is being negotiated.<\/p>\n<p class=\"wp-block-paragraph\">Negotiations, he added, must be suspended\u00a0immediately. \u201cThe commission\u00a0has disgraced itself\u00a0by conducting them.\u201d<\/p>\n<p><strong>WTF Happened to GDPR?<\/strong><\/p>\n<p>This is one of the many pertinent questions that have arisen in the wake of Statewatch\u2019s revelations. The European Commission said any agreement would \u201ccontain safeguards protecting fundamental rights, including data protection safeguards, such as restrictions on the use of data in connection with the death penalty\u201d.<\/p>\n<p>That assurance is worth nothing. Any data protection safeguards would be meaningless in the hands of the Israeli police force and Shin Bet. As Novara Media points out, it\u2019s not just Palestinian citizens who could be targeted as a result of this deal; so, too, could journalists and pro-Palestine and anti-war activists in Europe.<\/p>\n<p>This is all happening at a time when EU institutions are building up ever larger databases on EU citizens, linking up national security authorities with Europol while at the same time expanding the technical possibilities for biometric identification and automated data analysis. As we <a href=\"https:\/\/www.nakedcapitalism.com\/2026\/04\/the-eus-digital-prison-complex-is-ready-for-roll-out.html\">reported<\/a> just a few months ago, the EU\u2019s digital gulag is close to completion.<\/p>\n<p>And Israel is not the only country with which Brussels is negotiating a comprehensive data sharing agreement. It has also been negotiating a deal with the United States to exchange information for security screenings and identity verification related to border procedures and visa application.<\/p>\n<p>Negotiations for that deal began in 2022, when the Biden Administration <a href=\"https:\/\/www.nakedcapitalism.com\/2022\/07\/unbeknown-to-most-americans-washington-is-offering-to-share-its-largest-biometric-database-with-other-governments.html\">offered to share<\/a> the biometric data of US citizens \u2014 in many cases harvested without the consent of the citizens in question \u2014 with <a href=\"https:\/\/en.wikipedia.org\/wiki\/Visa_Waiver_Program\" target=\"_blank\" rel=\"nofollow noopener\">all 40 countries<\/a> selected for the US government\u2019s Visa Waiver Program (VWP), which include 23 EU Member States. On one proviso: that those countries reciprocated.<\/p>\n<p>This, one assumes, is how digital public infrastructure like digital identity and central bank digital currencies will become interoperable across international borders. While the negotiations between the US and the EU have been conducted somewhat more openly, the EU Commission\u2019s current proposal still \u201cmanifestly violates EU law\u201d, Statewatch <a href=\"https:\/\/statewatch.org\/analyses\/2026\/eu-us-data-exchange-proposal-in-conflict-with-eu-laws\/\" target=\"_blank\" rel=\"nofollow\">reported<\/a> in May:<\/p>\n<blockquote>\n<p>It\u00a0goes much further than their limited mandate for negotiation granted by\u00a0the Council of\u00a0the EU\u00a0and against essential data protection safeguards set out by\u00a0the European Data Protection Authorities. Anyone\u2019s data exchanged under this proposed agreement could be\u00a0used for a\u00a0wide range of\u00a0purposes. This includes preventing or\u00a0arresting people travelling to\u00a0the USA who have voiced opposition to\u00a0US policies in\u00a0Europe, or\u00a0for automated discriminatory profiling of\u00a0travellers, including EU\u00a0citizens.<\/p>\n<\/blockquote>\n<p>The EU has until December 31 to agree to Washington\u2019s demands to open their biometric databases to US border officials. Otherwise, they could lose visa-free travel to the US. Given how the Trump administration is increasingly using visas as a weapon, revoking or restricting travel and student visas to exert geopolitical pressure, punishing critics and rewarding allies, that may not be such a bad thing.<\/p>\n<p>Meanwhile, the EU\u2019s secret plan to hand over EU citizen\u2019s data to a state committing multiple genocides still remains largely secret \u2014 thanks to the fact that most European media outlets have responded to Statewatch\u2019s revelations by studiously ignoring them.<\/p>\n<p>The Von der Leyen Commission would much prefer it if everybody else did the same. As O\u2019Mulrooney notes, \u201cthe Commission ignored its lawyers. It ignored the ICJ. It ignored its parliament. It kept meeting, kept negotiating, kept refusing to comment, and hoped nobody would notice.\u201d<\/p>\n<p>\u201cStatewatch noticed.
